The NC Psychology Board does not license behavior analysts. A board has been created for behavior analyst board in NC. They are now accepting applications. Behavioral analysis is listed under the definition of the practice of psychology in the NC Psychology Practice Act and one must be licensed by this Board or another NC Board who considers this under their scope of practice in order to provide behavioral analysis. National certification is not a substitute for state licensure.
Currently, some unlicensed personnel (such as BCBAs) can perform some functions of behavioral analysis under the direct supervision of a licensed psychological associate or licensed psychologist under the ancillary services rules of the Board Rules (Section .2800), provided that the psychologist provides training and supervision to the unlicensed individual, has seen the client for services themselves, and maintains all ethical responsibility for the quality of services provided under their licensure. This would include the implementation of the behavior plan by the ancillary staff.
To provide behavioral analysis without licensure or to provide the limited duties of behavioral analysis allowed within the ancillary services rules without complying with the ancillary services rules would be considered the unlawful practice of psychology without a license.
